User Acknowledgment of Warnings and Operating Instructions

This User Acknowledgment of Warnings and Operating Instructions (“Acknowledgment”) confirms that the adult user identified below has received, reviewed, and acknowledged the Product warnings and operating instructions before first use.

1. Definitions

“Mitolux,” “we,” “us,” or “our” means Mitolux LLC.

“Product” means any Mitolux ultraviolet device, light device, accessory, replacement part, charger, stand, mount, component, product labeling, packaging, user manual, warning material, or related item provided by Mitolux.

“User,” “you,” or “your” means the adult person who will operate, use, or be exposed to the Product.

“Written Instructions” means the Product labeling, user manual, quick-start guide, warning labels, checkout disclosures, contraindications, exposure schedule, minimum-distance requirements, maintenance instructions, and any materially consistent updates made available by Mitolux at:

2. User Confirmation

I confirm that I am at least 18 years of age.

I confirm that I am the intended adult user of the Product identified in the related order, purchase, or acceptance flow.

I confirm that I have been provided access to the Written Instructions and have had the opportunity to review them before purchase or before first use.

I understand where to access the full User Manual, safety warnings, contraindications, and operating instructions for the Product.

3. Acknowledgment of Safety Warnings

I understand and acknowledge that the Product may emit ultraviolet light and that improper use, overexposure, incorrect distance, excessive frequency, failure to use required protective measures, or failure to follow the Written Instructions can cause serious harm.

Potential risks may include, without limitation:

Eye injury;
Skin injury;
Burns;
Overexposure injury;
Photosensitivity reactions;
Irritation;
Aggravation of existing conditions;
Other bodily harm;
Property damage.

I understand that individual responses may vary based on skin type, eye sensitivity, medications, medical history, photosensitivity, prior UV exposure, and other personal factors.

4. Acknowledgment of Operating Instructions

I acknowledge and agree that:

I will read the Written Instructions before first use;
I will use the Product only for its intended purpose and only as described in the Written Instructions;
I will follow all stated requirements regarding exposure time, protective eyewear, minimum distance, frequency of use, positioning, and ventilation;
I will follow all warning labels and safety precautions provided with the Product;
I will stop use if I experience adverse effects and will seek appropriate medical guidance when warranted;
I will not use the Product if I am unable or unwilling to follow the Written Instructions;
I will keep the Product away from minors and will not permit anyone under 18 years of age to use the Product;
I will not modify, tamper with, bypass safety features, or use non-approved accessories if doing so would conflict with the Written Instructions;
I will not use the Product if it appears damaged, malfunctioning, altered, or unsafe.

5. Contraindications and Medical Considerations

I acknowledge that certain medical conditions, medications, skin sensitivities, eye sensitivities, photosensitivity concerns, history of UV sensitivity, history of cancer, doctor advice to avoid sun exposure, or other health circumstances may increase the risk of adverse effects.

I understand that I must review all contraindications, precautions, and medical considerations in the Written Instructions before use.

I understand that Mitolux does not provide medical advice and that I am responsible for consulting a qualified healthcare professional when appropriate.

6. No Reliance on Inconsistent Statements

I understand that safe operation depends on following the Written Instructions.

I agree not to rely on any statement, image, advertisement, review, video, social media post, customer comment, website content, or customer-service statement that is inconsistent with the Written Instructions.

In the event of any inconsistency between general website content, promotional content, advertising content, customer-service statements, or other materials and the Written Instructions, I understand that the Written Instructions control.

7. Personal Acknowledgment Only

I am completing this Acknowledgment for myself as the intended adult user of the Product.

I understand that any other adult user must separately complete any warning acknowledgment, safety acknowledgment, and release required by Mitolux before use.

I agree not to permit any third party to use the Product unless such person has independently received, reviewed, and acknowledged the applicable warnings and instructions required by Mitolux.

8. No Waiver of Non-Waivable Rights

This Acknowledgment is intended to document receipt, review, and understanding of warnings and instructions.

This Acknowledgment is not a release of liability and does not waive any right that cannot lawfully be waived.

I understand that Mitolux cannot control actual use conditions after delivery and that safe operation depends on user compliance with the Written Instructions.

9. Electronic Signature and Record

By checking the required acceptance boxes, typing my legal name, and clicking the acceptance button, I confirm that the information I have provided is true and correct and that I am electronically signing this Acknowledgment for myself.

I consent to electronic records relating to this Acknowledgment and agree that electronic acceptance records may be retained by Mitolux to the maximum extent permitted by law.

Mitolux may retain records of acceptance, including legal name, email address, phone number, IP address, timestamp, document title, document version, effective date, checkbox selections, order number, and related device, browser, or session information.

10. Required Fields

The user acceptance flow should collect:

Full Legal Name;
Email Address;
Phone Number, if required by Mitolux;
Order Number, if applicable.

11. Required Checkboxes

The user acceptance flow should require separate affirmative checkboxes confirming:

I am 18 years of age or older.
I am the intended adult user of this Product.
I have read and understand the safety warnings above.
I will read the Written Instructions before first use.
I will use the Product only as instructed and within stated time, distance, frequency, positioning, protective eyewear, and ventilation requirements.
I understand that improper ultraviolet exposure can cause eye injury, skin injury, burns, and other harm.
I understand that failure to follow warnings and instructions increases the risk of injury.
I will not allow anyone under 18 years of age to use the Product.
I understand that any additional adult user must separately review and accept Mitolux’s required warnings, instructions, and release documents before use.
