My order arrived damaged. What should I do?

Buyer has ten (10) days after delivery to report receipt of a damaged item. Please inspect your product carefully and report any damages within the 10-day period. Mitolux is not responsible for damages reported after the 10-day period. We will require photo and video proof of receiving a product that is damaged so that we can address the issue with the manufacturer or shipping company.

Do the bulbs need to be replaced?

You do not need to replace bulbs as the LEDs have an expected lifespan of 10,000+ Hours for UVB and 50,000+ for RED/NIR

Why do the UVB LEDs appear to be not working?

Ultra Violet B( 280-320nm) is just beyond the visible spectrum (400nm-700nm) - hence it is invisible to the naked eye. You will actually only be able to see a small white dot or perhaps a very subtle blue hue emanating from the UVB LEDs when they are 'on'. Please rest assured that there is a significant amount of light energy emanating from those LEDs and your Mitolux Light is in fact working exactly as designed. You can also test it with your Cell Phone since the sensor has some sensitivity to UVB lights.

What is the refund policy? How can I return my light for a refund?

REFUND POLICY
Mito Red offers a full 30-day trial of all products. The 30-day trial period commences upon customer’s receipt of the product. Return shipping is paid by you. We require that returns be sent back in the original packaging to prevent damage in transit. You shall retain the tracking information to provide proof of delivery to Mito Red. Mitolux is not liable for lost or damaged return shipments and we reserve the right to charge for any damages you caused to the product.
Refunds for customers choosing to return during the 30-day trial period are 100% of product cost – any elective expedited shipping costs and international shipping costs are non-refundable.
Returns must note your full name and order number. Returns must be postmarked before the end of the 30-day trial period. Returns after the 30-day trial period will not be accepted.
If the returned product is damaged in any way or returned in an un-sellable condition. the shipment will be refused and returned to sender.

Damages

Refunds
Once your return is received and inspected, you will be sent an email to notify you that the item has been received. If the refund is approved then the refund will be processed and a credit will automatically be applied to your credit card or original method of payment.

Exchanges
Items will be replaced if they are defective or damaged, subject to the damages proof requirements, meaning, we will require photo and video proof of receiving a product that is damaged. If you need to exchange the item for the same item, you must send an email to support@mitolux.com requesting the exchange.

How long does the coverage last?

The Mitolux comes with a 30-day return period as well as a 1-year limited warranty. The limited warranty is not transferable and may be voided if the product ownership changes. All claims must be submitted by the original purchaser. 

What do you have to do?

To obtain warranty service, you must first submit a service request form, available here. Once completed in its entirety, our service team will contact the customer via email to provide support. All claims must be submitted by the original purchaser. 

Service and repair

In the instance your device should require service and/or repair, our service team will provide additional instructions for the device(s) to be shipped to our service center. All services and/or repairs must be completed by authorized Mitolux technicians. Upon completion of our post-service testing, the device will be shipped back to the customer.

Limitation of Liability

Except as provided in this warranty and to the maximum extent permitted by law, the company is not responsible to buyer or any third party for direct, special, incidental or consequential damages resulting from any breach of express or implied warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property. The company’s liability shall under no circumstances exceed the actual amount paid by you for the defective product. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
The foregoing limitations shall not apply to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions.

Indemnification

Buyer agrees to defend, indemnify, and hold harmless Company, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, suits, actions, demands, disputes, allegations, or investigations brought by any third party, governmental authority, or industry body, and all liabilities, damages, losses, costs, and expenses, including without limitation reasonable attorneys’ fees, arising out of or in any way connected with (i) Buyer’s access to or use of the Company website, including, without limitation, Buyer’s access to or use of any information presented on or through the Company website, (ii) Buyer’s user contributions to the Company website, (iii) Buyer’s breach or alleged breach of any warranties made by Buyer hereunder or Buyer’s violation of any other provision of these terms, or (iv) Buyer’s violation of any law or the rights of a third-party. Company reserves the right to assume control of the defense of any third-party claim that is subject to indemnification by Buyer, in which event Buyer will cooperate with Company in asserting any available defenses.

What is the warranty?

Who may use this limited warranty?

Mitolux LLC (“Company”) warranties apply to Mitolux light therapy devices (“Product” or “Products”), and only for Products, purchased through www.mitolux.com. This limited warranty applies to consumer use only and does not apply when the Product is used in a commercial or institutional setting.

The Company warrants the Products against defects materials and workmanship when used normally in accordance with the applicable instructions for use provided in the operating and service manual for the Product during the applicable warranty period. During the warranty period, Company will repair or replace, at no charge, Products or parts of Products that prove defective because of improper material or workmanship, under normal use and maintenance.

The Company may change the availability of this limited Warranty at its discretion, but any changes will not be retroactive.

What will we do to correct the problems?

If during the applicable warranty period you submit a valid claim to the Company, Company will, at its option, (i) repair the Products at no charge, using new or refurbished replacement products or parts of Products, or (ii) replace the Product with a functionally equivalent product at no charge, or (iii) exchange the Product for a refund of the purchase price. Shipping and handling charges may apply except where prohibited by applicable law.

If you want to return the device under the 30 day Guarantee period, the shipping costs are paid by the user and you should send the box with all items in perfect condition.

For the first 60 days, the Company will be responsible for all shipping costs related to your request if located within the United States, within the. If you're no longer located within the country the order was originally shipped to, shipping costs will be your responsibility. After the first 60 days, Buyer will be responsible for Product shipping charges and related coverage while in transit to Company. 
Any replacement Product will be warranted for the remainder of the original warranty period.

What does the limited warranty not cover?

This limited warranty does not apply to: (a) cosmetic damage; (b) damage caused failure to follow the product instructions or to perform any preventive maintenance; (c) modifications; (d) unauthorized repair; (e) damage due to transportation; (f) damage due to liquid contact; (g) damage due to storage; (h) theft or loss of the product; (i) defects caused by normal wear and tear or otherwise due to the normal aging of the Product; and (j) to damage due to external causes such as accidents, abuse, damage by natural causes like lightning, floods, or other natural disasters, or other actions or events beyond the reasonable control of the Company. In addition, component parts or products manufactured by a third party (“Third Party Product”) may constitute, contain, be contained in, incorporated into, attached to or packaged together with, the Product. Third Party Products are not covered by this Limited Warranty, and The company makes no representations or warranties with respect to any third-party product, including any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; (c) warranty of title; or (d) warranty against infringement of intellectual property rights of a third party; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.

Please note, in order to proceed with a service request, you may be instructed to comply with various troubleshooting tasks, per the request of our service team.

Implied Warranties

Except to the extent prohibited by applicable law, all implied warranties (including, without limitation, warranties of merchantability and fitness for a particular purpose) shall be limited in duration to the duration of the applicable warranty period. Some jurisdictions do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.

Governing Law

This limited warranty shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.

Risk of Loss

Buyer agrees to use the Products only in the manner for which it is intended and in compliance with the instructions and warnings set forth in the operating and service manual included with the Products. Buyer is responsible for, and assumes all risk of, loss or theft of, or damage to, the Products provided to it hereunder. The Products shall be covered by the warranty set forth in the operating and service manual included with the Products. Except as set forth in the operating and service manual, Company makes no warranty, express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose, and specifically disclaims all liability for indirect or consequential damages.

This product is not intended to cure or threat any disease. 

Return Policy 

Our devices includes a 30-day return period. Please note that all opened Mitolux returns are subject to a restocking fee. Additional details are as follows:
All kits and configurations must be returned in full with original packaging for all devices and components. Must be in like-new condition. Returns without all the original packaging and components will be subject to refusal and returned to the sender.
Orders are not eligible for exchange or substitution. 
Original shipping costs are non-refundable. 
All returns received with damaged or missing components will be subject to refusal and returned to sender.
Return shipping and costs will be your responsibility. Please note that we cannot be held liable for lost or damaged shipments that are returned to us.
After completing form, we'll provide you with a return authorization number.
This return policy is limited to purchases from mitolux.com. If you purchased your Mitolux through an authorized retailer, please contact them.
Returns must be postmarked before the end of the 30-day return period, which commences upon receipt of the product. Returns shipped after 30 days will not be accepted.
Returns postmarked before the end of the 30-day return period—and received opened or used—will be subject to a $50 restocking fee. To avoid this fee, items must be returned unopened and within the original vacuum-sealed packaging.
All returned products will be inspected and processed within 3-5 days of receipt.
All international returns are required to ship to our return center located in the U.S.
The original and return shipping costs will be deducted from the total refund for all orders refused at the carrier level and/or returned to sender. Please note, these orders may be subject to additional fees and require an extended processing window, as the item must be received and inspected before a refund is issued.
All returns must be pre-approved and provided an authorization number. Any orders returned without an authorization number and/or shipped to the wrong address will be the customers responsibility. Joovv is not liable for lost or refused returns that did not follow our mandatory instructions. 
If an item is returned to us that is not authorized for return or refund, we will attempt to contact you. We will hold the item(s) for 30 days before discarding.
We reserve the right to reject/refuse the refund for items that do not fit these qualifications. The customer will pay to have the items shipped back to them if items are sent to us outside of the time frame and/or not approved for return.
Please note, if the customer modifies the shipping address, shipping method, or any other alterations via the carrier, mitolux is not responsible for delays, lost packages and/or failed delivery as a result of these modifications.
