Limited Warranty
Mitolux LLC ("we," "us," or "our") is pleased to provide this limited warranty ("Warranty") to customers ("you" or "your") who have purchased our products. This Warranty covers the specific product(s) you have purchased from us, subject to the terms and conditions outlined below.
Warranty Coverage
Mitolux LLC warrants that its products shall be free from defects in material and workmanship for a period of one (1) year from the date of purchase by the original purchaser ("Warranty Period"). If a defect arises during the Warranty Period, Mitolux LLC, at its option and to the extent permitted by law, will (1) repair the product using new or refurbished parts, (2) replace the product with a new or refurbished product, or (3) refund the purchase price of the product. This Warranty applies to any repair, replacement, or refund of the product.
Warranty Conditions
To be eligible for this Warranty, you must be the original purchaser of the product and have purchased it directly from Mitolux LLC or an authorized Mitolux LLC distributor or reseller. This Warranty is not transferable and is only available to the original purchaser.
This Warranty covers only defects in material and workmanship, including any failure to meet product specifications, as set forth in the applicable product documentation. The Warranty does not apply to any damage caused by accident, abuse, misuse, flood, fire, earthquake, or other external causes, or to damage caused by operating the product outside the permitted or intended uses described by Mitolux LLC.
How to Obtain Warranty Service
If you believe you have a valid warranty claim, please contact us at +1-800-356-1773 or support@mitolux.com. We may require you to provide proof of purchase as evidence that you are the original purchaser. We will provide instructions for returning the product and may require that you return the product to us. You are responsible for the cost of shipping the product to us.
Warranty Disclaimer
To the extent permitted by law, this Warranty and the remedies provided herein are exclusive and in lieu of all other warranties, remedies, and conditions, whether oral, written, statutory, express, or implied. Mitolux LLC disclaims all statutory and implied warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose and non-infringement.
Limitation of Liability
To the extent permitted by law, Mitolux LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or your inability to use the product; (b) any unauthorized access or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the product; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the product; and (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the product, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Mitolux LLC has been informed of the possibility of such damage.
Exclusions and Limitations
This Warranty does not cover any non-Mitolux LLC products or services. Mitolux LLC does not warrant that the operation of the product will be uninterrupted or error-free. This Warranty is limited to the purchase price of the product.
Applicable Law and Venue
This Warranty is governed by and construed under the laws of the State of [Your State] and the United States of America. Any dispute arising under or in connection with this Warranty shall be subject to the exclusive jurisdiction of the federal and state courts located within the State of [Your State].
