These Terms of Service (“Terms”) govern your access to and use of the Mitolux website located at www.mitolux.com, including any related webpages, customer-support pages, and digital content made available through the website (collectively, the “Site”).

Please read these Terms carefully. By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, please do not use the Site.

1. Scope of These Terms

These Terms govern website access and website use only.

These Terms do not by themselves govern any product purchase, shipment, return, limited warranty, product-use acknowledgment, or release of liability. Those matters are governed, where applicable, by separate documents presented at checkout or through a separate end-user acceptance flow, including the Purchase Terms, Limited Warranty, Important Safety Warnings, User Acknowledgment of Warnings and Operating Instructions, and Release of Liability and Assumption of Risk.

2. Eligibility

You may use the Site only in compliance with applicable law. You must be at least 18 years old to place an order through the Site.

Mitolux products are not intended for use by minors. Product-use requirements, warnings, and user eligibility conditions are stated in the separate purchase and product-use documents provided by Mitolux.

3. Privacy and Electronic Communications

By using the Site, you acknowledge that Mitolux may collect, use, and disclose information as described in its Privacy Policy.

You agree that Mitolux may provide confirmations, notices, support communications, and other records electronically, to the extent permitted by law.

4. Permitted Use of the Site

Subject to these Terms, Mitolux grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for your personal, lawful, non-commercial use.

You may not:

  • Use the Site in violation of any law or regulation;

  • Interfere with Site security or functionality;

  • Use bots, scrapers, or automated means to access the Site without Mitolux’s written permission;

  • Copy, reproduce, distribute, modify, or create derivative works from the Site content except as allowed by law or with Mitolux’s written permission;

  • Use the Site to transmit malicious code, spam, or deceptive material; or

  • Misrepresent your identity or provide false information through the Site.

5. Accounts and Account Security

If Mitolux offers account functionality, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

You agree to provide accurate information and to update it as necessary. Mitolux may suspend or terminate accounts, or restrict Site access, if Mitolux reasonably believes these Terms have been violated or Site security is at risk.

6. Product Information; No Medical Advice

The Site may include product descriptions, educational materials, FAQs, safety information, manuals, and other content for general informational purposes.

Site content is not medical advice and is not a substitute for professional medical judgment. You are responsible for reviewing all product labeling, warnings, manuals, and instructions provided with the product and for consulting an appropriate professional when needed.

Mitolux may update Site content from time to time but does not guarantee that all Site content is complete, current, or error-free.

7. Orders and Separate Transaction Documents

If you purchase a product through the Site, your order is governed by the separate Purchase Terms and Limited Warranty provided at checkout or otherwise made available by Mitolux.

If you are an intended user of the product, or if another adult will be the intended user, Mitolux may require completion of separate safety, acknowledgment, and release documents before shipment or before first use, as applicable.

In the event of any conflict between these Terms and any separately presented Purchase Terms, Limited Warranty, or product-use document, the more specific transaction or product-use document will control that subject matter.

8. Reviews, Feedback, and Other Submissions

If you submit reviews, comments, suggestions, or other content to Mitolux through the Site, you grant Mitolux a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, display, and distribute that content in connection with Mitolux’s business, subject to applicable law and Mitolux’s Privacy Policy.

You represent that any content you submit is accurate, lawful, and does not violate the rights of any person or entity. Mitolux may remove submitted content at any time, in its discretion.

9. Intellectual Property

The Site, including its design, text, graphics, logos, icons, images, software, and other content, is owned by or licensed to Mitolux and is protected by applicable intellectual-property laws.

Except for the limited right to use the Site under these Terms, no license or ownership right is granted to you.

10. Third-Party Links and Services

The Site may contain links to third-party websites, tools, or services. Mitolux does not control and is not responsible for the content, availability, or practices of third-party services.

Your use of third-party services is at your own risk and subject to the third party’s terms and policies.

11. Site Availability; Changes to the Site

Mitolux may modify, suspend, or discontinue any part of the Site at any time, with or without notice.

Mitolux does not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

12. Disclaimer of Website Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, EXCEPT AS EXPRESSLY STATED IN A SEPARATE WRITTEN LIMITED WARRANTY PROVIDED BY MITOLUX.

TO THE FULLEST EXTENT PERMITTED BY LAW, MITOLUX DISCLAIMS ALL IMPLIED WARRANTIES WITH RESPECT TO THE SITE AND SITE CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THIS SECTION APPLIES TO THE SITE AND SITE CONTENT ONLY. IT DOES NOT REPLACE ANY SEPARATE WRITTEN LIMITED WARRANTY THAT APPLIES TO A PRODUCT PURCHASE, AND IT DOES NOT LIMIT ANY NON-WAIVABLE RIGHTS YOU MAY HAVE UNDER APPLICABLE LAW.

13. Limitation of Liability for Site Use

TO THE FULLEST EXTENT PERMITTED BY LAW, MITOLUX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SITE OR SITE CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, MITOLUX’S AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO MITOLUX FOR THE SPECIFIC WEBSITE-RELATED TRANSACTION GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

THIS SECTION APPLIES ONLY TO CLAIMS ARISING FROM SITE ACCESS OR SITE USE. IT DOES NOT GOVERN PRODUCT-USE CLAIMS, DOES NOT REPLACE ANY SEPARATE PURCHASE OR PRODUCT-USE DOCUMENT, AND DOES NOT LIMIT LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mitolux and its officers, directors, employees, agents, affiliates, and service providers from and against claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party.

15. Termination

Mitolux may suspend or terminate your access to the Site at any time if Mitolux believes you have violated these Terms, applicable law, or Site security requirements.

Sections that by their nature should survive termination will survive, including sections regarding intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute-related provisions.

16. Governing Law; Forum; Non-Waivable Rights

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, except to the extent that non-waivable consumer-protection law of your state of residence applies.

Unless applicable law requires otherwise, any dispute relating to these Terms or the Site must be brought in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.

Nothing in these Terms waives, limits, or disclaims any right or remedy that cannot lawfully be waived, limited, or disclaimed.

17. Changes to These Terms

Mitolux may revise these Terms from time to time. The updated version will be posted on the Site with a revised effective date.

Your continued use of the Site after revised Terms become effective constitutes your acceptance of the revised Terms.

18. Entire Agreement for Site Use Only

These Terms, together with any policies expressly incorporated into them, are the entire agreement between you and Mitolux regarding your use of the Site only.

These Terms do not replace or supersede any separate Purchase Terms, Limited Warranty, product warnings, user acknowledgments, or release documents that Mitolux presents in connection with a product purchase or product use.
